Co-Habitation
Divorce is costly both emotionally and financially with the additional cost of long term maintenance being a significant drain on your salary and future standard of living.
Some financial settlements are reached on the proviso that maintenance payments to the former partner are either reduced or curtailed if they co-habit with a new partner. In the event of the former partner beginning a new relationship and cohabiting with their new partner the agreed maintenance payments are either reduced or stopped.
Quite often this state of affairs results in the former-partner concealing the fact they are co-habiting with a new partner in order to retain the higher level of maintenance payments.
In many cases there may be anecdotal evidence of co-habitation from children of the family, neighbours or local gossip however this is insufficient to satisfy a court that the former partner is co-habiting.
To prove co-habitation, one needs to present the court with solid and irrefutable evidence in the shape of video and photographic of the new partner co-habiting with the former partner.
